Undocumented Students

Undocumented students are (1) foreigners that entered the United States without inspection or with fraudulent documents, or (2) entered the United States lawfully as a non-immigrant but then violated the terms of their status and stayed in the United States without proper authorization. Receiving an education is a right every child has, and Molina Law Group is here to help support and defend all undocumented students.

Public School for Undocumented Students

Every child in America is guaranteed a right to public education regardless of what their immigration status is. Since the ruling of Plyler v. Doe in 1982, schools can no longer ban any child from any public K-12 school. To stay within the United States and attend school your or the student must be considered, “currently in school.” To be considered, “currently in school” you or the student must be formally enrolled in one of the following:

  • A private or public elementary school, middle or junior high school, or a secondary school
  • A literacy, education, or career training program that is designed to place the student in a postsecondary job training and education that will lead to employment.
  • A program that assists students in obtaining their high school diploma or GED.

College for Undocumented Students

Any person in the United States, no matter their immigration status, can enroll in and attend a college or university. There is no federal law prohibiting these students from attending any college or university, however, it’s important to look up each college or university to see their own rules regarding admissions, and then apply like any other student would.

We know that enrolling in school, whether it’s public school or college, can be scary and overwhelming. There are many laws in place to protect all those that wish to attend public school or college, the right to do so.
