Provisional Unlawful Presence Waiver

The Provisional Unlawful Presence Waiver (Form I-601A) is for immediate family members of US citizens that are already present in the United States. This waiver is so the foreign national can leave the United States for their consulate interview, and re-enter without the five to 10-year bar that unlawfully present immigrants face. If the immigrant does not qualify for an Adjustment of Status this waiver is another good option.

Eligibility Requirements for The Provisional Unlawful Presence Waiver:

  1. Must be within the United States
  2. Must be 17 years old and older
  3. Must be active in the process of obtaining an immigrant visa.
  4. Must be able to show the full understanding that the waiver could be denied, and the denial could cause extreme hardship to the US Citizen or Legal Permanent Resident.
  5. Must be in the United States for 180 days or more in one visit.
